TERMS OF SERVICE

Welcome to Write Launch Grow (“Website,” “Platform,” or “Service”), operated by Winterwolf Enterprises LLC (“Company,” “We,” “Us,” “Write Launch Grow,” or “Our”), a Nevada-based company. These Terms of Service (“Terms”) govern your use of this Website and all affiliated platforms operated by the Company, including but not limited to:

  • AuthorPlayground.com

  • BookBingers.com

  • BooksAreWaiting.com

  • WinterwolfPress.com

By accessing, using, or remaining on WriteLaunchGrow.com or any affiliated site, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Website and all associated services.

 

1. ELIGIBILITY & ACCOUNT REQUIREMENTS

1.1. Minimum Age Requirement: You must be at least 18 years old to create an account. If you are under 18, you may only use the Website with parental or legal guardian consent. Parents or guardians are responsible for monitoring their child’s activity on the Website.

1.2. Legal Compliance & Restrictions: By using the Services, you represent and warrant that:

  • You can legally form a binding contract with Write Launch Grow and Winterwolf Enterprises LLC under applicable laws.
  • If you are located in California, the EU, or any region with strict data protection laws, you must comply with local regulations regarding online activity and parental consent for minors.
  • You are not prohibited from receiving our services under the laws of the United States or any other applicable jurisdiction.
  • You do not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or any similar government sanctions list.
  • You are not located in or acting on behalf of an entity located in a U.S.-sanctioned country (e.g., one subject to an embargo or designated as a “terrorist-supporting” country).
  • You are not listed on any U.S. Government list of prohibited or restricted parties.
  • You agree to comply with all applicable local, state, national, and international laws, rules, and regulations regarding your use of our Services.

1.3. Business or Entity Use: If you are using our Services on behalf of a business or other entity, you represent that you are authorized to agree to these Terms on behalf of the business or entity and that all provisions apply to that organization.

1.4. Account Security & Accuracy: You must provide accurate, current, and complete registration information and maintain the security of your account credentials. You are solely responsible for any activity under your account. If you suspect unauthorized access, you must notify us immediately.

 

 

2. USER ACCEPTANCE & THIRD-PARTY LINKS

2.1. Agreement to Terms
By accessing, using, or remaining on this Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service (“Terms”) and the Write Launch Grow Privacy Policy If you do not agree with these Terms, you must immediately discontinue use of the Website.

Use of any community space or group feature also constitutes agreement to our Community Guidelines & Code of Conduct (see Section 26).

2.2. Applicability
These Terms apply to all users, including those who contribute content, information, or other materials or services on the Website.

2.3. Third-Party Links & Disclaimer

  • The Website may contain links to third-party websites that are not owned or controlled by Write Launch Grow.
  • Write Launch Grow does not endorse, control, or assume responsibility for any content, privacy policies, or practices of third-party websites.
  • Write Launch Grow is not responsible for monitoring, censoring, or editing third-party content.
  • By using the Website, you expressly release Write Launch Grow from any and all liability related to your use of third-party websites.
  • We encourage users to be aware when leaving the Write Launch Grow Website and to review the terms and privacy policies of any external sites they visit.

 

3. SERVICES PROVIDED

3.1. Courses & Digital Content: Write Launch Grow offers educational materials, tools, AI-based assistance, masterminds, coaching, podcasts, vlogs, blogs, and forms to support writers.

3.2. AI & Human-Generated Advice: AI-generated content, as well as advice provided in masterminds, coaching sessions, podcasts, vlogs, blogs, or any other media on the platform, is for informational purposes only and does not replace professional guidance.

3.3. Community Participation: We may provide access to unmonitored community spaces. You understand that content in these areas is user-generated, and we are not responsible for interactions between members. Use these spaces at your own risk.

Community access may be provided through our web platform and/or mobile apps (such as Passion.io), which include private groups, discussion threads, and peer support. Participation is optional, and users agree to follow our community guidelines.

We may occasionally offer community experiences via third-party platforms (e.g., Facebook Groups). Use of such platforms is voluntary and governed by their own terms and privacy policies.

3.4. Memberships & Access: Some services may be available through a membership model. By subscribing to a membership, you agree to pay the required fees and abide by all terms. Membership benefits, access levels, and fees may change at our discretion.

3.5. Membership Renewal & Cancellation: Memberships may renew automatically unless canceled. You can cancel your membership at any time through your account settings. Cancellations will take effect at the end of the current billing cycle, and no refunds will be issued for partial membership periods.

3.6. Third-Party Integrations: The Platform integrates with ThriveCart, CartFlows, Passion.io, WooCommerce, Stripe, and various third-party applications, including Google Analytics, Google Fonts, and other Google services. You acknowledge that these services operate under their own terms, and we are not liable for their actions or data collection practices.

3.7 Beta Features & Service Previews: We may occasionally offer new tools, features, or services in a beta or experimental state. These may be labeled as “beta,” “preview,” “limited release,” or similar. Beta features are offered as-is, without guarantees of uptime, compatibility, or full functionality. We reserve the right to discontinue or modify such features at any time.

Your use of beta features is entirely voluntary and constitutes acceptance of any associated limitations or risks.

3.8. Author Website Hosting: Authors may create and manage personal author websites on our multisite platform. These sites may include individual landing pages for books, categorized sections for fiction and nonfiction, contact pages, lead magnet forms, embedded payment buttons (e.g., Stripe or PayPal), and blog-style content. Users are responsible for the content and legality of their individual sites.

3.9. Book Promotion Tools: We offer optional promotional opportunities, such as:

  • Chapter-based release tools through BookBingers.com

  • Reader discovery platforms through BooksAreWaiting.com

  • Article, excerpt, or story submissions via AuthorPlayground.com

  • Featured listings, spotlight author sections, and Rising Star promotions

3.10. Affiliate & Monetization Tools: Eligible users may gain access to affiliate tracking tools to refer other users or promote their content through platform-approved channels. Terms and participation rules apply.

3.11. Reader Access & Discovery Tools: Readers may access select areas of the Platform and its affiliated sites (e.g., BooksAreWaiting.com, BookBingers.com) to discover new books, preview chapters, engage with featured content, and join email lists for authors or genres they enjoy. Reader-facing tools may include:

  • Unlockable chapter programs (Chapter Chasers)

  • Genre- or interest-based book discovery engines

  • Author spotlights and Rising Star showcases

  • Optional newsletter sign-ups or social media sharing incentives

Some reader features may be available without an account, while others may require free or paid registration.

Reader Discretion Notice:
Some books or content shared on the Platform may contain emotional or psychological triggers, sensitive topics, or fictional portrayals of real-world issues. We do not verify or censor user-submitted material. Please use discretion when choosing what to read or engage with.

3.12. Co-Writing & Collaboration Tools: We support collaborative writing opportunities between authors, editors, marketers, and creatives. This may include:

  • A matchmaking space for co-writing projects

  • Collaboration boards for pitching shared ideas

  • Tools for authors to list collaboration opportunities or respond to others

  • Optional services to facilitate group projects, anthologies, or multi-author bundles

3.13. Shared Universe & Fan Fiction Projects: We may offer platforms for contributors to build and participate in shared literary universes. These programs are opt-in and governed by specific guidelines that define:

  • Ownership and attribution

  • Licensing of contributed content

  • Canonical rules and creative restrictions (if applicable) Participation is voluntary, and all contributors agree to the applicable content guidelines upon entry.

3.14. Educational & Creative Challenges: The Platform may offer writing prompts, themed challenges, sprints, or educational mini-events that allow users to:

  • Practice their craft

  • Submit optional entries for public showcasing

  • Win promotional features or platform perks Participation is optional, and terms may vary by challenge.

3.15. Resource Library & Templates: Users may access a growing collection of downloadable or AI-assisted resources, including:

  • Book planning worksheets

  • Series development systems (e.g., WRITE, SPARKS, PLANNER, etc.)

  • AI-guided character builders, plot testers, and naming tools

  • Template-based landing pages, lead magnets, and reader funnels

Resources may vary by membership level and are for personal use only.

3.16. Feedback, Beta Reader & ARC Services: Select tools and opportunities may be available to help authors:

  • Recruit beta readers or early reviewers

  • Collect structured feedback

  • Offer ARC (Advanced Reader Copy) access

  • Gather testimonials or blurbs for launch materials

We do not guarantee that any beta reader or reviewer will access, read, or respond to an author’s submission. Participation by readers and reviewers is voluntary, based on interest and availability. While we may offer a private library or request-based catalog where authors can submit works for consideration, we cannot ensure that any individual will select, open, or provide feedback on the material. Authors are welcome to seek their own beta readers or reviewers outside the Platform, and participation in our program is optional.

Our beta reader and reviewer tools are designed to facilitate connection—not guarantee results. We provide infrastructure for discovery, but all engagement is at the discretion of readers. Authors understand that submission to a shared catalog or private library does not ensure that their work will be read, reviewed, or responded to.

Participation for authors and readers in beta reader or reviewer programs is completely voluntary and unpaid. Write Launch Grow does not compensate readers for feedback, reviews, or promotional engagement. Readers may discontinue participation at any time.

By participating, readers acknowledge that their feedback is considered a goodwill contribution and waive any claims of ownership, compensation, or co-authorship. Write Launch Grow is not responsible for author responsiveness, communication quality, or outcomes of beta reader relationships.

By participating in any beta reader, reviewer, or ARC opportunity offered through Write Launch Grow, you acknowledge and agree to these Terms. Your participation is voluntary and constitutes your understanding that these activities are unpaid, independent, and not subject to employment, contract, or compensation claims. You agree that any feedback you provide may be shared with the author and used to improve their work, and that Write Launch Grow is not responsible for disputes, communication failures, or negative experiences that may arise during the process.

By submitting reviews, feedback, or comments through any beta reader, reviewer, or ARC opportunity on the Platform, you grant Write Launch Grow and the associated author a non-exclusive, royalty-free license to display, quote, excerpt, or publish your submitted content—on or off the Platform—including but not limited to websites, newsletters, books, promotional materials, and social media. You acknowledge that your comments may be attributed to your first name, username, or initials unless you request anonymity in writing.

Comment Visibility Notice:
By posting comments, reviews, or public messages on any author page or book listing, you grant the author and the Platform the right to display your words in public forums, including websites, social media, book blurbs, or promotional materials. You may request removal by contacting us, but we are not obligated to comply once the material has been published.

Optional Author Agreements:
Some authors may choose to request a separate non-disclosure agreement (NDA) or confidentiality terms before allowing access to unreleased content, especially for sensitive, private, or high-stakes projects. These agreements are created and enforced directly between the author and the reader, and Write Launch Grow is not a party to them.

By volunteering as a beta reader or reviewer, you acknowledge that an author may ask you to review or sign additional agreements before participation. You are not obligated to accept such terms. If you do, you enter into a direct agreement with the author, and any obligations or expectations arising from that agreement are solely between you and the author.

3.17. Community-Led Groups & Events: In addition to official Write Launch Grow events, users may create or join unofficial peer groups, co-working sessions, or accountability threads within the Platform’s community areas. All users agree to our Community Guidelines and Terms of Use.

3.18. Author Monetization & Paid Content Features: Eligible users may promote paid books, coaching services, or exclusive content through their author pages, embedded tools, or linked services. Authors are responsible for the legality, fulfillment, and customer communication regarding any product or service they offer directly through their author page.

3.19. Community Guidelines & Legal Use of Content
All users who post, share, or engage with content on the Platform (including stories, chapters, blogs, comments, messages, or visual media) agree to follow our Community Guidelines and Code of Conduct, which include but are not limited to:

  • Respectful communication

  • No hate speech, harassment, or abusive behavior

  • No illegal, plagiarized, or harmful content

  • Clear rights to any content you upload or submit

By submitting content through any part of the Platform (including author sites, community forums, or public showcases), you affirm that:

  • You own or have legal permission to share the material.

  • You grant Write Launch Grow and Winterwolf Enterprises LLC the right to host, display, promote, and share your content across our affiliated sites.

  • You agree that content submitted to public sections (e.g., Author Playground, Book Bingers, or contest entries) may be reviewed by Winterwolf Press for possible publishing opportunities. No publishing deals will occur without your written consent.

Write Launch Grow reserves the right to remove or suspend content or users that violate these terms.

3.20. Future Services & Expansions: Write Launch Grow is an evolving platform committed to providing innovative tools, creative opportunities, and community-driven features to support authors, readers, and literary entrepreneurs.

We may introduce new services, features, or collaborations that are not explicitly listed in this section. These may include—but are not limited to—experimental tools, partnerships, licensing opportunities, publishing assistance, app-based experiences, integrations with emerging technologies, or additional community offerings.

Any new service, whether temporary, trial-based, beta, or permanent, shall be considered part of the Platform and governed by these Terms of Service unless otherwise stated. Users will be notified of significant updates or feature launches as they become available.

3.21. Independent Author Pages, Transactions & Policies: Authors using Write Launch Grow’s platform to create and manage their own author websites or book landing pages are considered independent content providers and sellers. The Company does not review, endorse, or guarantee any content, product, service, or transaction listed on an author’s individual website.

Authors may embed or link to external checkout systems (e.g., PayPal, Stripe, Ko-fi, etc.) to sell books, merchandise, courses, coaching sessions, or other offerings. These transactions are solely between the author and the buyer. Write Launch Grow:

  • Does not process payments or provide customer service on behalf of authors

  • Is not responsible for refund policies, product delivery, or content accuracy

  • Is not liable for any disputes, losses, or damages resulting from purchases made on an author’s independent site

Each author is responsible for creating, publishing, and enforcing their own policies regarding:

  • Refunds, cancellations, and returns

  • Delivery timelines or digital access instructions

  • Terms of service and privacy policy for their visitors and customers

  • Compliance with all applicable consumer protection laws

By purchasing from or interacting with an individual author site, users acknowledge that they are doing so at their own risk and that Write Launch Grow is not a party to those transactions.

Reader Notice:
Readers, buyers, and site visitors accessing an author’s individual website, landing page, or product listing—whether through a link on Write Launch Grow, a promotional spotlight, or a third-party feature—acknowledge that all content, offers, and transactions originate solely from that author.

Write Launch Grow does not verify or guarantee the accuracy, quality, safety, legality, or delivery of any products, services, or claims made by individual authors.

Any concerns, requests, or disputes must be directed to the author or seller. By interacting with or purchasing from any author-linked page, you agree that Write Launch Grow is not liable for issues arising from such interactions.

3.22. User Collaborations & Co-Creation
Write Launch Grow provides optional spaces and tools for users to connect, co-write, co-market, or build projects together. These collaborations are entirely user-initiated and outside the control of the Platform. You acknowledge and agree that:

  • All communication, agreements, deliverables, and outcomes are between the participating users.

  • Write Launch Grow is not responsible for disputes, failures, or losses resulting from collaboration.

  • Users engaging in co-creation are strongly encouraged to create written agreements to protect their interests.

3.22. Reader, Beta Reader & Reviewer Engagement
While Write Launch Grow offers tools to help users connect with readers, beta readers, and reviewers, we do not guarantee participation, engagement, or feedback. You acknowledge that:

  • Reader and reviewer involvement is voluntary and not guaranteed.

  • Engagement depends on your personal outreach, presentation, and the interests of the audience.

  • Write Launch Grow is not liable for a lack of engagement, negative feedback, or missed opportunities.

4. WEBSITE ACCESS & USE

4.1 Limited License
Write Launch Grow grants you a limited, non-exclusive, non-transferable, and revocable license to use the Website for personal and non-commercial purposes. You agree that:

  • You will not copy, distribute, modify, or reproduce any part of the Website without prior written permission.
  • You will use the Website only for its intended purpose and in compliance with these Terms.

4.2 Account Registration & Security
To access certain features, you must create an account. By doing so, you agree that:

  • You will not share your account or use another user’s account without permission.
  • You must provide accurate, complete, and updated information during registration.
  • You are solely responsible for all activities under your account and must keep your password secure.
  • You must immediately notify WWrite Launch Grow of any unauthorized use or security breach. Write Launch Grow is not responsible for your losses from unauthorized use, but you may be liable for losses incurred by the Company or others due to such unauthorized use.

4.3 Prohibited Activities
You agree not to:

  • Use automated systems (bots, spiders, scrapers, or offline readers) that generate more traffic than a human can reasonably produce.
  • Collect, harvest, or store personally identifiable information of other users.
  • Use the Website’s communication systems for commercial solicitation or spamming.
  • Disrupt or attempt to interfere with the Website’s security, services, or operations.

4.4 Search Engine Crawling
Write Launch Grow permits public search engines to crawl the Website for indexing purposes but not to store, cache, or archive content. We reserve the right to revoke this permission at any time.

 

5. USER RESPONSIBILITIES

5.1. Prohibited Conduct: You agree NOT to:

  • Use the Platform for illegal activities.
  • Share, sell, or distribute course content without permission.
  • Post harmful, offensive, or inappropriate content in community spaces.
  • Misuse AI-generated or human-provided content for deceptive, malicious, or harmful purposes.
  • Use or launch automated systems, including but not limited to “robots,” “spiders,” or “offline readers,” that send more requests to our servers than a human could reasonably produce.
  • Collect or harvest personally identifiable information from the Website without consent.

5.2. Community Conduct & Reporting
Users agree to uphold respectful, lawful, and honest engagement within all community-facing areas of the Platform, including but not limited to discussion threads, peer groups, public content submissions, or collaboration spaces. We do not tolerate:

  • Harassment, discrimination, or abusive behavior

  • Deceptive practices or impersonation

  • Posting illegal or plagiarized material

  • Soliciting private or financial information from other users

If you experience harm, harassment, or ethical misconduct from another user or author, you may report it to us at:

While we are not responsible for author conduct or transactions, we will investigate credible reports and may suspend or remove offending accounts at our sole discretion.

5.3 Author Sites & External Payment Links

Authors who use the Platform to create and manage their own author websites or book landing pages are solely responsible for the accuracy, legality, and performance of all content and payment-related activities they initiate.

The Company does not act as a payment processor or financial intermediary for transactions made through user-embedded buttons (e.g., Stripe, PayPal, or similar services). You are responsible for managing your own payment gateway settings, tax obligations, refund policies, and customer communications.

You agree to indemnify and hold harmless the Company from any claims, liabilities, or disputes arising from the use of external sales tools or links hosted on your author pages.

5.4. Parental Responsibility for Minors: Parents or guardians of users under 18 must ensure compliance with these Terms. The Company does not knowingly collect personal data from children under 13 without verified parental consent (COPPA Compliance).

 

Children’s Accounts & Parental Responsibility

  • Parents or legal guardians may create an account on behalf of their minor child to access our homeschooling programs. By registering a child, the parent or guardian agrees to these Terms and assumes full responsibility for monitoring their child’s activity.
  • If a child under 13 registers without parental consent, the account may be suspended until consent is verified or permanently deleted.
  • Parents or guardians can manage their child’s participation, including requesting data deletion, content removal, or restrictions on public interactions by emailing admin@writelaunchgrow.com.
  • Public Content: If a minor posts content in forums, writing challenges, or community features, parents acknowledge that such content may be publicly visible and take responsibility for monitoring their child’s submissions.
  • Educational Use Only: Our homeschooling and kid’s writing programs are designed as educational tools for families. We do not provide direct one-on-one services, tutoring, or child supervision. Parents remain responsible for their child’s learning experience.

 

 

6. USER ACTIVITY & ACCEPTABLE USE

6.1 Permitted Use
Write Launch Grow is an educational and retail platform. You may use the Website only for lawful purposes and in compliance with these Terms. You agree that all content provided by Write Launch Grow (“Company Materials”) is for informational purposes only and is provided “as is” without warranties, guarantees, or professional certifications (e.g., medical, legal, or psychological advice).

6.2 Prohibited Activities
You agree not to:

  • Engage in illegal, fraudulent, or tortious activities.
  • Violate intellectual property laws (e.g., copying, distributing, or altering content without permission).
  • Distribute adult content, hate speech, child exploitation, defamatory or harassing material, or any content that violates U.S. or international laws.
  • Post, upload, or distribute viruses, malware, or harmful scripts.
  • Infringe trademarks, copyrights, patents, or trade secrets of any third party.
  • Use automated systems (e.g., bots, scrapers, spiders) to extract website data.
  • Impersonate another person or misrepresent your affiliation with Write Launch Grow.
  • Engage in spamming, phishing, or other deceptive marketing practices.

6.3 User-Generated Content
You retain ownership of your submitted content, but by posting on Write Launch Grow, you grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to use, distribute, modify, and display your content for business operations.

6.4 Copyright & DMCA Compliance
Write Launch Grow respects intellectual property rights. If you believe your copyright is being infringed, you may submit a Digital Millennium Copyright Act (DMCA) takedown request to:

6.5 Violation Consequences
Write Launch Grows reserves the right to:

  • Suspend or terminate accounts violating these Terms.
  • Remove content that violates intellectual property or legal policies.
  • Report illegal activities to authorities when required.

 

 

7. PAYMENT, REFUNDS & TERMINATION

7.1. Payment Processing: Transactions occur via ThriveCart, CartFlows, Passion.io, WooCommerce, Stripe, and other integrated third-party payment services. You agree to abide by their respective payment and refund policies.

7.2. Billing & Renewal:

  • The Services will commence on the date your order is accepted by Write Launch Grow (the “Effective Date”) and will continue on a monthly or annual billing cycle.
  • Payments will be automatically processed on your Billing Date via your selected payment method (credit card, PayPal, or other).
  • If funds are unavailable or a payment attempt fails, Write Launch Grow may retry payment periodically until the balance is cleared.
  • Annual subscribers will receive an email notification before renewal, allowing them to continue or cancel services before their next charge.

7.3. Refund Policy: Unless explicitly stated otherwise, purchases are non-refundable once access to digital content has been granted.

7.4. Membership Cancellation & Refunds:

  • Memberships may be canceled at any time, but no refunds will be issued for partial membership periods.
  • Canceled memberships remain active until the end of the current billing cycle.

7.5. Suspension for Non-Payment:

  • Write Launch Grow reserves the right to suspend or restrict services if fees are past due.
  • If your subscription is terminated due to non-payment, access to courses, resources, and other services will be revoked until payment is resolved.

7.6. Termination:

  • 7.6. Termination by Client:
    • Clients may cancel their membership at any time.
    • Termination will take effect at the end of the current billing cycle, and no further charges will be made.
    • No refunds will be issued for unused portions of the service.
  • 7.7. Termination by Write Launch Grow:
    • Write Launch Grow reserves the right to terminate accounts immediately if a user violates these Terms or engages in conduct detrimental to the platform.
    • We reserve the right to suspend or terminate accounts at our sole discretion, without prior notice and without providing a reason.
    • If we determine that a user has violated these Terms or engaged in any behavior detrimental to the platform, their access may be revoked immediately.

 

8. ASSIGNMENT

8.1. Assignment of Rights

  • You may not transfer, assign, or sublicense your rights under these Terms to any third party.
  • Write Launch Grow reserves the right to assign or transfer its rights and obligations under these Terms without restriction.

 

9. NO GUARANTEE OF RESULTS & INDEMNIFICATION

9.1 No Guarantee of Results:
Write Launch Grow does not guarantee, imply, or predict any specific results, profits, success, or responses from the use of its Services. The Client acknowledges that results may vary and that Write Launch Grow is not responsible for any interruptions, data loss, deletion, or service conditions beyond its reasonable control.

9.2 Indemnification:
The Client agrees to indemnify, defend, and hold harmless Write Launch Grow, its officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, losses, damages, expenses, suits, demands, or costs, including reasonable attorneys’ fees, arising out of or relating in any way to:
(i) The Client’s use of the Services,
(ii) Any content submitted, posted, or transmitted by the Client,
(iii) Any violation of these Terms by the Client, or
(iv) Any violation of applicable laws or regulations.

This indemnification shall survive the termination of this Agreement and the Client’s use of the Services.

 

10. THIRD-PARTY RIGHTS

You acknowledge and agree that the owners of the Content and certain distributors (such as app store providers) are intended beneficiaries of the Agreements and have the right to enforce the Agreements directly against you. Other than as set out in this section, the Agreements are not intended to grant rights to anyone except you and Write Launch Grow, and in no event shall the Agreements create any third-party beneficiary rights. Furthermore, the rights to terminate, rescind, or agree to any variation, waiver, or settlement of the Agreements are not subject to the consent of any other person.

If you have downloaded the App from the Apple, Inc. (“Apple”) App Store or if you are using the App on an iOS device, you acknowledge that you have read, understood, and agree to the following notice regarding Apple. This Agreement is between you and Write Launch Grow only, not with Apple, and Apple is not responsible for the Service and the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service. In the event of any failure of the Service to conform to any applicable warranty, then you may notify Apple and Apple will refund any applicable purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service. Apple is not responsible for addressing any claims by you or any third-party relating to the Service or your possession and/or use of the Service, including: (1) product liability claims; (2) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (3) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement and discharge of any third-party claim that the Service and/or your possession and use of the App infringe that third-party’s intellectual property rights. You agree to comply with any applicable third-party terms, when using the Service. Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement. You hereby represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.

 

11. CLIENT DATA USAGE:

By using the Services, you agree that Write Launch Grow may collect, store, and use data provided by you in accordance with the Write Launch Grow Privacy Policy. The Privacy Policy, which is incorporated by reference into these Terms, governs how we collect, use, and protect your data. We will only use your data as outlined in the Privacy Policy and in compliance with applicable laws, including but not limited to GDPR and CCPA.

Please note, however, that certain aspects of your use of the Write Launch Grow Service may be governed by additional agreements. That could include, for example, access to the Write Launch Grow Service as a result of a gift card, free or discounted Trials, or together with other services. When you are presented with an offer for such aspects of your use, you will be presented with any related additional agreement, and you may have an opportunity to agree to additional terms. To the extent that there is any irreconcilable conflict between any additional terms and these Terms, the additional terms shall prevail.

 

15. SEVERABILITY, WAIVER AND INTERPRETATION

Unless as otherwise stated in the Agreements, should any provision of the Agreements be held invalid or unenforceable for any reason or to any extent, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of the Agreements, and the application of that provision shall be enforced to the extent permitted by law.

Any failure by Write Launch Grow or any third-party beneficiary to enforce the Agreements or any provision thereof shall not waive Write Launch Grow’s or the applicable third-party beneficiary’s right to do so.

As used in these Terms, the words “include” and “including,” and variations thereof, will be deemed to be followed by the words “without limitation.”

 

16. ASSIGNMENT

Write Launch Grow may assign the Agreements, and any of its rights under the Agreements, in whole or in part, and Write Launch Grow may delegate any of its obligations under the Agreements. You may not assign the Agreements, in whole or in part, nor transfer or sub-license your rights under the Agreements, to any third-party.

 

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Write Launch Grow, its parent company, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising from or related to:

  • Your use of and access to the Write Launch Grow Website and Services.
  • Any User Content you post, upload, or otherwise contribute.
  • Any activity in which you engage on or through the Write Launch Grow Service.
  • Your violation of any term of these Terms of Service.
  • Your violation of any third-party rights, including but not limited to copyright, intellectual property, privacy, or ownership rights.
  • Any claim that content you place on the Write Launch Grow site caused harm to a third party.
  • Any claim that you listed or sold items on the Write Launch Grow platform without proper rights or authorization.

This defense and indemnification obligation survives these Terms of Service and continues even after you stop using the Write Launch Grow Website.

 

18. CHOICE OF LAW, MANDATORY ARBITRATION, AND VENUE

18.1 Governing Law & Jurisdiction

These Terms, and any disputes or claims arising from them, shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to conflict of law principles. You agree that any legal disputes not subject to arbitration shall be resolved exclusively in the United States District Court for the District of Nevada.

18.2 Arbitration Agreement (U.S. Users Only)

18.2.1 Dispute Resolution & Arbitration

You and Write Launch Grow agree that any dispute, claim, or controversy between you and Write Launch Grow arising from or relating to these Terms (whether in contract, tort, statute, fraud, misrepresentation, or any other legal theory) shall be resolved through binding individual arbitration.

🚫 No Court Trial or Jury: Arbitration is more informal than court proceedings. There is no judge or jury, and court review of arbitration decisions is limited. The arbitrator may award the same damages as a court but cannot issue broad injunctive relief that affects other users.

18.2.2 Exceptions to Arbitration

The following disputes are NOT subject to arbitration:

  1. Small Claims Court: Either party may bring an individual action in U.S. small claims court.
  2. Injunctive Relief: Either party may seek temporary or preliminary injunctive relief in court to prevent misuse of intellectual property.
  3. Regulatory Complaints: You may file complaints with state or federal agencies that, by law, can seek remedies on your behalf.
18.2.3 Class Action Waiver

  • If any part of this waiver is deemed invalid, only that specific claim may proceed in court—all other claims must remain in arbitration.
18.2.4 Arbitration Rules & Process
  • Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Arbitration hearings will take place in your county of residence unless both parties agree to another location.
  • If your claim is $25,000 or less, you may choose:
    1. A decision based solely on written documents.
    2. A telephonic or online hearing.
    3. An in-person hearing in your county.
18.2.5 Notice of Arbitration

  • Other Fees: Write Launch Grow will not pay your arbitration fees unless required by AAA rules or court order.
  • If You Win: If arbitration results in an award higher than Write Launch Grow’s  last settlement offer, you will receive the greater of:
    • The arbitration award amount OR
    • $1,000 USD
18.2.7 Confidentiality of Arbitration

All arbitration proceedings, documents, and settlement discussions must remain confidential unless disclosure is required by law.

 

18.2.8 Enforceability of This Section

If this arbitration agreement is deemed unenforceable, disputes shall only be resolved in Nevada courts under Section 13.1.

 

19. GENERAL TERMS

19.1 Jurisdiction & Governing Law

  • The Write Launch Grow website and services are operated from Las Vegas, Nevada, USA.
  • These Terms of Service shall be governed by the laws of the State of Nevada, USA, without regard to conflict of law principles.
  • Any legal disputes not subject to arbitration shall be resolved exclusively in the United States District Court for the District of Nevada.

19.2 Entire Agreement

  • These Terms, along with our Privacy Policy, Billing Policy, and any other legal notices published by Write Launch Grow, constitute the entire agreement between you and Write Launch Grow.
  • Any previous agreements, whether oral or written, are hereby superseded.
  • If any provision of these Terms is deemed invalid or unenforceable, the remainder shall remain in full force and effect.

19.3 Amendments & Updates

  • Write Launch Grow reserves the right to amend these Terms at any time without prior notice.
  • Any changes will be posted on our website, and continued use of the service constitutes acceptance.

19.4 Limitation on Legal Actions

24. OWNERSHIP OF USER-CREATED CONTENT & AI-ASSISTED WORKS

24.1. User Ownership

Write Launch Grow respects your creative rights. You own all content you create on our platform, including but not limited to manuscripts, outlines, character developments, world-building notes, and any other materials you generate.

We do not claim ownership of your work, nor will we sell, distribute, or use it for commercial purposes without your explicit permission.

24.2. Limited License to Host & Operate Services

By using our platform, you grant Write Launch Grow a limited, non-exclusive, royalty-free, revocable license to store, process, display, and allow authorized personnel to access your content for the following purposes:

  • Hosting your work on our website, platform, and secure servers.
  • Providing editorial, coaching, or training services (if applicable).
  • Allowing access to designated team members, including developers, trainers, coaches, editors, and authorized guests who assist with the platform.
  • Performing technical maintenance, troubleshooting, and backups to ensure smooth platform operation.

This license does not give us the right to use, modify, sell, or publicly distribute your content beyond these necessary functions.

Authorized access to your content is strictly limited to necessary service functions. No individual or team member may download, use, repurpose, or copy your work for personal or commercial use without your explicit, written consent. All access is logged and monitored for privacy compliance.

24.3. AI-Assisted vs. AI-Generated Work

Our platform offers AI-assisted features to help you brainstorm, organize, and refine your writing. However, AI-generated content (where AI writes most of the material) may not be fully copyrightable under current U.S. laws.

  • AI-Assisted Work (where you make significant creative contributions) is generally eligible for copyright protection.
  • AI-Generated Work (where AI creates the majority of content) may not qualify for copyright protection under current regulations.

You are responsible for ensuring that your final work meets copyright requirements before publishing.

24.4. Privacy & Confidentiality

Your work will be kept private from the public unless you choose to share it. However, certain authorized individuals—such as our web team, staff, coaches, trainers, invited guests, and editors—may have backend access to your content for service-related purposes.

All authorized personnel are bound by confidentiality agreements to protect your work. If you have concerns about privacy, we recommend reviewing our Privacy Policy.

24.5. Future AI Implementation

If we introduce AI-generated writing tools in the future, we will provide clear options to distinguish AI-assisted vs. AI-generated content, ensuring that you maintain control over your work.

24.6. Public Sharing & Submissions

Write Launch Grow respects your privacy and creative rights. By default, all content you create on our platform remains private and accessible only to you and authorized personnel involved in platform operations.

24.6.1. Public Submissions Require Explicit Consent

If you choose to submit content for public distribution, contests, guest blogs, or featured stories, you will be required to sign an additional agreement specifying:

  • Where and how your work will be displayed (e.g., website, newsletter, social media).
  • Whether you retain full ownership or grant us a broader license for promotional use.
  • Any compensation, attribution, or exclusivity terms (if applicable).

By submitting content to any Write Launch Grow public-facing features (including Book Bingers, Author Playground, Chapter Chasers, or Reader Highlights), you grant us the right to review the content for editorial and publishing potential. Selected submissions may be referred to Winterwolf Press for possible publishing opportunities, though no publishing agreements will be enacted without your explicit consent.

25. AI-DRIVEN SERVICES, DATA RETENTION & PRIVACY

Write Launch Grow integrates AI-powered tools, chatbots, and virtual writing assistants to help users develop, outline, and complete their books and series. These tools store and recall user interactions to maintain continuity across projects.

25.1 AI Assistance & Memory Storage

To provide long-term AI support for writing projects, we store AI-generated interactions, including:

  • User-submitted prompts, outlines, and manuscripts
  • AI-assisted brainstorming sessions, character development notes, and plot structures
  • Customer support chats with AI and human agents for troubleshooting and assistance

This memory allows AI agents to recall context from previous interactions, ensuring continuity in book series planning and writing assistance.

25.2 User Control Over AI Data

Users may:

  • Request access to stored AI interactions
  • Delete AI-stored content upon request (note that deleting AI memory may impact continuity in multi-book projects)
  • Opt-out of AI memory retention by contacting admin@writelaunchgrow.com (opting out may limit AI assistance)

 25.3 AI-Generated vs. AI-Assisted Work

Users retain full ownership of AI-assisted content but acknowledge that:

  • AI-assisted writing includes user input and creative contributions, making it generally copyrightable.
  • Fully AI-generated work (where AI produces most of the content with little human input) may not qualify for copyright protection under current U.S. law.
  • Users are responsible for verifying copyright eligibility before publishing.

25.4 Team Access & Confidentiality

Authorized team members (including AI trainers, editors, and support staff) may review AI-generated interactions to:

  • Improve AI responses and platform performance
  • Provide editorial guidance when requested by users
  • Troubleshoot errors and ensure AI accuracy

All team members with access are bound by strict confidentiality agreements to protect user data.

25.5 AI Limitations & Disclaimer

While Write Launch Grow strives for accuracy, AI-generated content:

  • May contain inaccuracies or outdated information

  • Write Launch Grow is not responsible for outcomes of user collaborations.

26.4. Content Conduct

  • You retain ownership of your content but grant us permission to host and share as outlined in Section 24.

  • If submitting work to public programs, you agree it may be shared with Winterwolf Press for consideration.

Note: Any claims, opinions, or advice presented by users or authors are their own and do not represent the views of Write Launch Grow. We do not verify factual accuracy or professional credentials. Readers and participants engage with content at their own discretion.

26.5. Reporting Violations

  • We reserve the right to suspend or ban users at our sole discretion.

26.6. Our Rights

27. PROMOTIONS, CONTESTS & GIVEAWAYS

27.1. No Guarantee of Winning Write Launch Grow may offer, host, or facilitate contests, drawings, giveaways, sweepstakes, or promotional games (including but not limited to: raffles, spinner wheels, random prize selections, and community challenges) through its platform or affiliated platforms. Participation in these promotions is completely optional and voluntary.

We make no guarantees that participants will win any prize or receive any reward.

27.2. Author-Sponsored Giveaways Occasionally, authors may offer free books, services, or merchandise as part of their own promotions. Write Launch Grow is not responsible for:

  • The availability, quality, or delivery of any author-sponsored prize
  • Ensuring the author follows through on their giveaway commitments
  • Resolving disputes between authors and recipients

When an author hosts a giveaway, they are solely responsible for fulfillment. Write Launch Grow merely provides a platform for such promotions and does not assume liability for the outcome.

27.3. Platform-Hosted Promotions For promotions hosted directly by Write Launch Grow, any physical or digital items offered as prizes are either:

  • Donated by participating authors or users
  • Purchased or sourced by Write Launch Grow for the purpose of community engagement

We will make reasonable efforts to deliver prizes as promised, but:

  • We are not liable for delays, shipping issues, or loss of items once they are sent
  • We reserve the right to substitute a prize of equal or greater value
  • All prizes are non-transferable and may not be exchanged for cash unless explicitly stated

Note on Third-Party Prize Fulfillment: Some prizes offered through promotions or giveaways may be fulfilled by third-party sponsors, such as authors or community contributors. Spinner Wheels, Random Generators & Game Features From time to time, Write Launch Grow may implement interactive or gamified features (such as spin-to-win wheels or random content unlocks) for engagement purposes. These are for entertainment and community fun. Participation is optional, and outcomes are random unless stated otherwise.

By participating in any promotion, contest, or giveaway hosted by Write Launch Grow or its affiliated partners, you agree to the above terms and acknowledge that:

  • Winning is not guaranteed
  • All prizes are subject to availability and may be adjusted or replaced
  • Author-sponsored giveaways are the responsibility of the author

28. PUBLISHING SUBMISSIONS & OPPORTUNITIES

28.1. Voluntary Submissions to Winterwolf Press: Write Launch Grow users may have the opportunity to submit stories, books, or creative work for potential review by Winterwolf Press, our affiliated publishing imprint. Submission does not guarantee publication, compensation, or continued consideration. Publishing opportunities are limited, not guaranteed, and entirely at our discretion.

All publishing decisions are made at the sole discretion of Winterwolf Press. By submitting material for publishing consideration, you acknowledge that:

  • You are the legal creator or rights-holder of the submitted work.

  • No publishing agreement is implied or created by submission alone.

  • No editing, distribution, or promotional action will take place without your signed, written consent.

28.2. Invitation-Based Opportunities: Users may be invited to submit material to contests, showcases, or guest features that include a referral to Winterwolf Press. Such referrals are not a guarantee of review, acceptance, or offer.

Writers who are selected for publishing opportunities will receive a direct invitation and, if accepted, will be presented with a publishing agreement outlining:

  • Rights and licensing terms

  • Royalties and payment structure

  • Editing and editorial collaboration expectations

  • Print and digital distribution details

28.3. No Automatic Contracts or Publishing Promises: Winterwolf Press does not engage in unsolicited acquisitions. Submission through Write Launch Grow is strictly voluntary and does not obligate the Company to review, publish, or provide feedback.

Publishing deals, contracts, or agreements will always be:

  • Provided in writing

  • Voluntarily signed by both parties

  • Separate from any terms outlined in this document

28.4. Hybrid Publishing Options: If Winterwolf Press offers hybrid publishing options (including paid services), authors will receive a transparent breakdown of:

  • Services included (e.g., editing, design, distribution)

  • Costs, timelines, and refund terms

  • Royalties and ownership structure

Participation in hybrid publishing is never required to use the Write Launch Grow platform.

28.5. Withdrawal of Submissions: You may withdraw your submission from consideration at any time by emailing: admin@writelaunchgrow.com. Once a publishing contract is signed, withdrawal may only occur under the terms of that agreement.

28.6. No Shared Rights from Platform Use: Unless a publishing contract is separately signed, you retain full ownership of all content submitted, created, or stored on Write Launch Grow. Platform use alone does not transfer, share, or license your publishing rights to Write Launch Grow or Winterwolf Press.
